The Department of Social Services (DSS) is comprised of the administrative units of the New York City Human Resources Administration (HRA) and the Department of Homeless Services (DHS). HRA is dedicated to fighting poverty and income inequality by providing New Yorkers in need with essential benefits such as Food Assistance and Emergency Rental Assistance. DHS is committed to preventing and addressing homelessness in New York City by employing a variety of innovative strategies to help families and individuals successfully exit shelter and return to self-sufficiency as quickly as possible.

The Centralized Fair Hearing Unit represents the Agency at New York State Administrative Hearings by presenting and defending Fair Hearing cases or resolving when appropriate. While representing the Agency, presents evidence manually or electronically, cross examines Appellants and provides the State Administrative Law Judge (ALJ) with a complete and relevant evidence packet and supporting documents to justify the challenged case action. Represents the agency at New York State Administrative Resolution/Settlement Hearings resulting from Same Day Resolution Conferences (SDRC) process. Ensures that requests for resolutions are forwarded to FIA Operations, The Fair Hearing Tracking Monitoring and Review Unit (FHTMRU) or the Office of Central Processing (OCP) as required. Reviews Fair Hearing decisions and recommends actions to challenge decisions when appropriate.

Fair Hearing Administration is recruiting for one (1) Associate Benefits Opportunity Specialist, Level III to function as Fair Hearing Representation Supervisor.

Under general direction of the Assistant Director of Fair Hearing Representation, with great latitude for independent judgment and initiative, represents and assists the Assistant Director in the day-to-day administration of the Fair Hearing Representation Unit; coordinates assignments and provides consultation guidance and assistance to Associate Job Opportunity Specialist Level II. The Associate Job Opportunity Specialist Level III (AJOSIII) supervises the day-to-day operation of the Fair Hearing Representatives at the hearing site.

The Fair Hearing Representation Supervisor will:

- Supervise day-to-day operations of Fair Hearing Representation; monitors and provides follow-up of fair hearing activities to ensure that actions are taken timely. Assist other program areas to ensure that the appropriate exchange of Fair Hearing information is available and provided.

- Observe Fair Hearings to determine the appropriate application of winning strategies in the Hearing Room; provide feedback to the Director of Fair Hearing Representation; prepare progress reports, develop corrective action plans, and ensure that efficient monitoring takes place; provides training as required.

- Monitor and maintain controls for the preparation and submission of Non-Managerial Employee Performance Evaluation reports. Ensure calendar coverage by staff members and assist with presentation of the Agency’s case actions before the New York State Administrative Law Judges (ALJ’s)

- Analyze fair hearing data, audits and other agency reports for review, discussion, Job Stat presentation. Monitor the Same Day Resolution Conference (SDRC) Unit and provide updates on process.

- Represent the Assistant Director of Fair Hearing Representation at Administrative meetings, providing Fair Hearing outcomes. Respond to inquiries from other agencies and the public.

- Meet with Family Independence Administration (FIA) Operations to discuss Fair Hearing outcomes and Fair Hearing avoidance. Reinforce policies to successfully defend the Agency’s actions.

Hours/Schedule: 9am – 5 pm with flex

ASSOCIATE BENEFITS OPPORTUNITY - 56316

1. A four-year high school diploma or its educational equivalent, and three years of
full-time satisfactory experience working directly in social/human services or a
related setting, providing either:
a) client services.
b) employment planning/counseling services which involves job development,
skills assessment, and employment placement or other economic
opportunity programming.
2. A baccalaureate degree from an accredited college; plus eighteen months of full time satisfactory experience working as a Benefits Opportunity Specialist; or
3. A baccalaureate degree from an accredited college; plus eighteen months of full time satisfactory experience as described in one (1) above.
4. College credit from an accredited college may be substituted for this experience
on the basis of 60 semester credits for 9 months of the work experience described
above. However, all candidates must have at least 18 months of full-time
satisfactory experience working as a Benefits Opportunity Specialist or performing
social/human services work as described in one (1) above.
