About The Role
The Chief Compliance Officer is a senior executive responsible for establishing, maintaining, and continuously enhancing the Company’s compliance function. This includes ensuring that all operations fully comply with Malta Financial Services Authority (MFSA) requirements, FIR‑03, applicable Maltese law, and relevant EU legislation. The CCO will oversee regulatory reporting, internal controls, risk monitoring, and act as the primary interface with the MFSA on all compliance matters.
The CCO must operate independently of the operational management of the institution, maintaining objectivity and ensuring that compliance oversight is effective, credible, and comprehensive.
Key Responsibilities
1. Establishment and Maintenance of the Compliance Function
• Maintain a permanent and effective compliance function in accordance with FIR‑03 and MFSA guidance.
• Monitor and assess the adequacy of the compliance program, including policies, procedures, and internal controls.
• Develop and implement the Compliance Monitoring Plan (CMP).
• Ensure the compliance function is sufficiently resourced, skilled, and has unrestricted access to relevant information.
• Maintain independence.
2. Regulatory Compliance
• Ensure ongoing compliance with all MFSA regulations, FIR‑03 rules, AML/CTF requirements, and applicable EU directives.
• Develop, update, and enforce company policies and procedures on compliance, anti-money laundering, counter-terrorist financing, risk monitoring, and internal governance standards.
• Woth a coordination with CRO maintain a documented system for regulatory risk management, internal control processes, and breach reporting.
3. Monitoring and Internal Controls
• Conduct regular compliance reviews and testing of policies and procedures.
• Detect and report breaches or deficiencies in compliance, assess root causes, and recommend corrective actions.
• Ensure that all compliance processes are proportional to the institution’s size, complexity, and risk profile.
4. Interaction with Regulatory Authorities
• Serve as the primary compliance liaison with the MFSA.
• Prepare and submit the Annual Compliance Report, including the approved CMP, identified breaches, and the status of corrective actions.
• Respond to regulator inquiries, inspections, and additional information requests.
• Support regulatory audits and inspections to ensure the institution’s full compliance.
5. Training and Awareness
• Develop and implement training programs for employees on compliance, AML/CTF, and regulatory obligations.
• Ensure personnel are fully aware of MFSA requirements, FIAU regulations, and internal compliance policies.
• Advise business units on regulatory matters and operational compliance.
6. Corporate Governance and Reporting
• Provide the Board of Directors and senior management with regular reports on compliance status, regulatory changes, and risk assessments.
• Ensure independent, objective, and transparent reporting of compliance performance and issues.
• Assist in the preparation and submission of the Annual Compliance Report along with audited financial statements.
• Maintain integrated and documented compliance architecture aligned with MFSA guidance.
Qualifications and Experience
• Bachelor’s or Master’s degree in Law, Finance, Risk Management, Accounting, or related field.
• Minimum of 3+ years’ experience in compliance roles in the financial services sector, ideally with EMI, PSP, fintech, or banking experience.
• Strong knowledge of MFSA regulations, FIR‑03, AML/CFT rules, FIAU Implementing Procedures, and EU regulatory requirements.
• Proven experience in developing and implementing compliance policies, procedures, and internal control frameworks.
• Excellent analytical, reporting, and communication skills; ability to interact effectively with the Board, management, and regulatory authorities.
• Ability to maintain independence and objectivity in oversight and reporting.
